Can the tenant end a time specified tenancy agreement that violates the Tenancy Act?

In the Tenancy Act there are rules about time specified tenancy agreements. Even if it says in the contract that the tenancy is time specified, the tenancy agreement must be considered unspecified, if the landlord does not uphold these rules.

Can the tenant in situations such as this, end the tenancy by giving notice with a three month notice period?

What is agreed upon?

The purpose behind the rule that the tenancy agreement becomes unspecified, is to give the tenant the right to continue living there. The purpose is however not to give the tenant the right to end the tenancy at an earlier time than what is agreed.

If it says in the written contract that the contract cannot be terminated during the tenancy, the tenant cannot give notice to end the tenancy at an earlier time than what follows from the contract.
