The tenant rents out the residence to someone else
Pursuant to the Tenancy Act the tenant is initially not permitted to rent out the residence to someone else. This follows from section 7-2 of the Tenancy Act.
If the tenant has rented the residence out to someone else without permission from the landlord, it constitutes a violation of the tenancy agreement. The landlord may consider giving notice for ordinary termination, or if there is grounds for termination with immediate effect.
Termination When can the landlord terminate the contract with immediate effect?If a live-in partner, spouse or the spouse's or live-in partner's immediate relatives move in with the tenant, they can do so. These cases are not considered renting out to others, and consequently does not require approval from the landlord.
Can the landlord refuse more people moving in with the tenant?In some cases the tenant is permitted to sub-let. In these cases the tenant must still ask the landlord's approval.
