When can the rent be increased?

Paying rent

Upon entering into the tenancy agreement, the landlord and tenant must agree on a specific amount of rent. During tenancy the agreed amount cannot be adjusted more than the law permits. The Tenancy Act gives way to two ways the amount can be regulated.

Index regulation

One way is regulating the rent once per year in accordance with the changes in the consumer price index. The consumer price index is a number calculated by Statistics Norway.

The landlord must notify the tenant in writing at least one month before the change take effect.

Example

If the tenancy was entered into January 1st, 2021, the landlord can send the tenant a written notice December 1st 2021 with a message that the rent will be increased from January 1st 2022.

Current level of rents

The other way is to adjust the rent every every third year to current level of rents. Current level of rents means the normal rent for that type of residence. Adjustments to current level of rents must be notified in writing six months in advance.

Example

If the tenancy agreement was entered into January 1st 2021 the landlord can send the tenant a written notification July 1st 2023 that she will be increasing rent to current level of rents from January 1st 2024.

It will vary over time what is considered current level of rents. It will depend on the tenancy market in general and circumstances with the specific residence. If the two of you do not agree about the current level of rents, you can submit a complaint to the Rent Disputes Tribunal and have a new current level of rents set.

If the tenant has paid an illegally high rent, the tenant can claim the exceeding amount reimbursed.
